Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof. . . .


In dealing with Establishment Clause cases, the Supreme Court has relied on the Lemon test:

• The government action must have a secular purpose.
• The primary effect of the government action must neither advance nor inhibit religion.
• The government action must not foster an excessive government entanglement with religion.
